The lane shouldn't be an issue now- the owner selling me the plot pays a service charge and all his land my plot included has the rights to use it.
The covenant is the real issue. My solicitor said exactly whats temp did that the builder retained the tiny patch of land to enforce the covenant. I don't intend to build on the tiny patch but they have retained it for enforcing the covenant and can and most likely will if I build on it. My solicitor wouldn't advise building without having this lifted/removed etc at the "ransom' of £30k.
From the research I have done, if i was to build it, the owners of the 3m2 plot could take me to court - and I would have to pay charges on what how much their land has devalued from my building which I suspect would be nothing- however the legal costs they would incur taking me to court, stress etc isn't worth it.
The neighbours benefiting from the covenant could take me to court too- and they have could argue my property has devalued there's but much , if anything I doubt it. But with potentially 8 neighbours to fight and legal costs I don't fancy my chances.
I think my only option really is to pay the builder the £30k and to see if I can win all 8 neighbours- how do I fancy my chances? slim to nothing.
However it's worth a go.
